Florida homeowner got foreclosure trial notice too late; appeals court reverses judgment, orders new trial

Robert Dwayne Harris has successfully appealed a foreclosure ruling against Nationstar Mortgage, LLC in Florida. The appeals court found that he did not receive adequate notice for his trial, which barred his defense from being presented. Acknowledging this oversight, Nationstar will now face a retrial in the lower court. Although the foreclosure sale proceeded, the court upheld the refusal of an injunction.
